Terms of Service

Article 1 - Purpose

These Terms of Service (hereinafter "Terms") define the conditions of use of the website momplans.co.uk (hereinafter "the Site") published by BP Les Cannisses KFT.

Use of the Site implies full acceptance of these Terms. If you do not accept these Terms, please do not use the Site.

Article 2 - Description of the service

MomPlans is a free connection service between individuals (hereinafter "Users") and FCA-authorised family protection and life insurance advisers (hereinafter "Partner Advisers").

BP Les Cannisses KFT acts as a business introducer.

In this capacity, MomPlans:

  • Is not an insurance broker and is not registered with the FCA
  • Does not provide personalised advice on insurance matters
  • Does not compare insurance contracts
  • Does not recommend specific products or insurance companies
  • Is strictly limited to connecting Users with Partner Advisers

Partner Advisers are independent professionals, properly registered with the FCA and authorised to conduct insurance brokerage activities. They are solely responsible for the advice they provide and the contracts they offer.

Article 3 - Access to the Site

The Site is freely accessible to any User with internet access.

All costs necessary to access the Site (computer equipment, internet connection, etc.) are borne by the User.

BP Les Cannisses KFT reserves the right to modify, suspend or discontinue access to the Site, in whole or in part, temporarily or permanently, without notice or compensation.

Article 4 - Use of the connection service

4.1. Connection process

To benefit from the connection service, the User must:

  1. Complete the contact form available on the Site
  2. Provide accurate and up-to-date information (first name, surname, email, telephone, family situation)
  3. Agree to be contacted by Partner Advisers by ticking the consent box

Once the form is submitted, the User's contact details are transmitted to one or more Partner Advisers selected by MomPlans.

A Partner Adviser contacts the User within 24 to 48 working hours, by telephone or email, to discuss their situation and needs.

4.2. Free service

The connection service is entirely free for the User. No fees will be charged by MomPlans to the User.

Partner Advisers are remunerated by insurance companies when a User takes out a contract. This remuneration does not result in any additional cost to the User.

4.3. No obligation to purchase

The User is under no obligation to take out an insurance contract after being contacted by a Partner Adviser.

The User is free to accept or refuse any proposals made by the Partner Adviser.

The User may at any time end the relationship with the Partner Adviser by informing them of their wish to no longer be contacted.

Article 5 - User obligations

The User agrees to:

  • Provide accurate, up-to-date and complete information when filling in the form
  • Not impersonate another person
  • Not use the Site for illegal, fraudulent or purposes contrary to these Terms
  • Not attempt to disrupt the operation of the Site or gain unauthorised access to the BP Les Cannisses KFT computer systems

In the event of a breach of these obligations, BP Les Cannisses KFT reserves the right to suspend or terminate the User's access to the Site, without notice or compensation.

Article 6 - Liability of BP Les Cannisses KFT

6.1. Limitation of liability

BP Les Cannisses KFT makes every effort to ensure the quality of the connection service. However, it cannot guarantee:

  • The permanent availability of the Site
  • The absence of errors or bugs on the Site
  • The compatibility of the Site with all browsers and operating systems

BP Les Cannisses KFT cannot be held liable for:

  • The use made by Users of information on the Site
  • The acts, omissions or failures of Partner Advisers
  • The quality, content or compliance of advice provided by Partner Advisers
  • Failure to take out an insurance contract following the connection
  • Direct or indirect damages resulting from use of the Site or inability to use it

6.2. Contractual relationship

The contractual relationship regarding the subscription of an insurance contract is established directly between the User and the Partner Adviser.

BP Les Cannisses KFT is not party to this relationship and cannot be held liable for any disputes that may arise between the User and the Partner Adviser.

In case of dispute with a Partner Adviser, the User should contact the Adviser directly or, where applicable, the FCA or the Financial Ombudsman Service.

Article 7 - Intellectual property

All content on the Site (text, images, graphics, logos, icons, sounds, software, site structure) is the exclusive property of BP Les Cannisses KFT or its partners, unless otherwise stated.

Any reproduction, representation, modification, publication or adaptation of all or part of the Site elements, by any means or process, is prohibited without prior written authorisation from BP Les Cannisses KFT.

Article 8 - Personal data

Personal data collected via the Site is processed in accordance with our Privacy Policy.

By using the Site, the User consents to the processing of their personal data under the conditions described in the Privacy Policy.

Article 9 - Hyperlinks

The Site may contain hyperlinks to third-party sites (Partner Advisers, commercial partners, etc.).

BP Les Cannisses KFT has no control over these third-party sites and disclaims all liability for their content, availability or privacy policies.

The User acknowledges that access to these third-party sites is at their own risk.

Article 10 - Modification of Terms

BP Les Cannisses KFT reserves the right to modify these Terms at any time, particularly to adapt them to changes in the Site, legislation or regulations.

Modifications will come into effect upon their publication on the Site.

Use of the Site after the publication of modifications constitutes acceptance of the new Terms.

Article 11 - Governing law and jurisdiction

These Terms are governed by English law.

In the event of a dispute relating to the interpretation or performance of these Terms, and failing amicable agreement, the dispute will be brought before the competent English courts.

However, in accordance with Regulation (EU) No 524/2013, consumers residing in the European Union may use the European Commission's online dispute resolution platform: https://ec.europa.eu/consumers/odr/
